Buying a cottage

Unlike buying a house or condo in the City, there's a lot more due diligence involved in buying a cottage property.

You may not have access to the cottage by way of a public road. Access may be over a private right of way across neighbouring properties. Not only do you have to do a full title search to discover whether a legal right of way exists, you've got to make sure that none of the neighbours have been trying to impede usage of the right of way. It's all well and good to have a legal right of access. But if the neighbour's are causing problems with using it, do you really want the hassle of trying to enforce your rights after closing? Most people aren't buying a cottage with the intention of engaging in litigation or disputes with neighbours.

Lawsuits filed for falling glass condos

In March, condominium owners at two Toronto condos launched two class action lawsuits related to  glass falling from their recently-purchased condominiums.The builders and architects involved with the development of Murano Towers and Festival Tower are being sued. In both cases, owners were prevented from using their balconies after panes of glass began falling off of the buildings in 2010.  The specifics of the claims can be viewed on the website of one of the law firms which launched the suits.

Quebec revamping condo laws?

The Ontario government has been hearing consumer feedback about the status of our existing condominium legislation over the last few months. At the same time, this Montreal Gazette article suggets that Quebec is also considering revamping its existing condominium laws.
 
We share a few similarities with Quebec when it comes to areas for improvement in condominium law. Like Ontario, condominium property managers in Quebec are not legally regulated. There is some suggestion that they should be, considering the amount of funds they are responsible for maintaining on behalf of condominium boards of directors. Also, although brand new construction is insured through the Tarion Warranty Corporation in Ontario, Tarion has never insured condominiums that are 'conversions' from a pre-existing building. Consumers are generally aware when they are purchasing a conversion unit that is not insured, although they may not appreciate the finer details of warranty coverage and why it is so important.

Do you have right to use a mutual driveway?

There was a real estate law article in the Toronto Star recently about a couple who purchased a home in Toronto. After closing, they objected to their neighbour continuing to use a driveway located on their property in order to access the garage at the back of the neighbour's house.
